Welcome! These terms outline how things work when you book Hariel Xavier Photography for your wedding or engagement session. We believe in being straightforward and honest, so there are no hidden surprises here — just a clear understanding of what you can expect from us and what we ask from you.
By booking our services, you agree to the terms below. If anything is unclear, please reach out — we’re always happy to chat.
To reserve your wedding date, we require a signed contract and a non-refundable retainer of 30% of the total package price. Your date is not officially held until both are received. We only book one wedding per day, so the retainer ensures we’ve set that day aside exclusively for you.
The remaining balance is due no later than two (2) weeks before your wedding date. If the balance is not received by that time, we reserve the right to cancel the booking.
We accept payment via the methods outlined in your invoice through our booking system (Studio Ninja). All prices are quoted in US dollars. Payment plans can be arranged upon request — just let us know if you’d like to break it up, and we’ll work something out.
If the final balance is not received by the due date (two weeks before the wedding), a late fee of $50 per week may apply. If payment remains outstanding at the time of the event, we reserve the right to withhold delivery of the final gallery until the balance is settled.
If you need to cancel, we understand — life happens. The retainer is non-refundable, as it compensates for turning away other bookings on your date. Any additional payments made beyond the retainer may be refundable depending on how far in advance you cancel:
We’re happy to reschedule your date one time at no additional charge, subject to our availability. The rescheduled date must fall within 12 months of the original date. A second reschedule may be subject to a rebooking fee of $250.
In the extremely unlikely event that we need to cancel, we will provide a full refund of all payments made, including the retainer. We will also make every effort to help you find a replacement photographer.
You can expect your full wedding gallery within 6 to 8 weeks after your wedding day. Engagement session galleries are typically delivered within 2 to 3 weeks. During peak season (September through November), delivery may take slightly longer. We’ll always keep you updated on the timeline.
We love sharing sneak peeks! You’ll typically receive a handful of edited highlights within 48 to 72 hours after your wedding, shared via social media or email.
The number of final images varies depending on the length of coverage, the flow of the day, and the events that unfold. We focus on quality over quantity — every image we deliver is one we’re proud of.
All images are professionally edited in our signature style. We do not provide unedited RAW files. Our editing includes color correction, exposure adjustments, and our creative processing. Extensive retouching (blemish removal, body alterations, etc.) is not included but can be requested for select images at an additional cost.
You receive a personal-use license with full print rights. That means you can print your photos, share them on social media, make albums, create gifts, hang them on every wall in your house — whatever makes you happy. We just ask that you credit Hariel Xavier Photography when sharing online (a tag is perfect!).
The photographer retains full copyright of all images under federal copyright law. We reserve the right to use your photos in our portfolio, website, social media, blog posts, advertising, print materials, and contest submissions. This is a huge part of how we grow our business and reach more couples.
Images may not be used for commercial purposes, sold to third parties, or submitted to competitions without written permission. Please don’t apply filters or heavy edits to the images before sharing — we put a lot of love into the editing, and we want your photos to look their best!
By booking with us, you grant Hariel Xavier Photography permission to use images from your session or wedding day for marketing, advertising, portfolio, social media, blog posts, and print materials. If you have any concerns about specific images being shared publicly, please let us know before or after your wedding and we will absolutely respect your wishes.
Beautiful wedding photography is a team effort. We ask that you share a reasonable timeline with us at least two weeks before the wedding so we can plan for the best possible coverage. We’re also happy to help you build a photography-friendly timeline — just ask!
During the event, we need reasonable access to the couple, wedding party, and family members during portrait times. Overly rushed timelines may affect the number and quality of photos we can capture.
We use professional-grade equipment and always carry backup cameras, lenses, and memory cards. In the rare event of a complete equipment failure, our liability is limited to a full refund of all fees paid. We are not responsible for any other damages, costs, or losses resulting from equipment malfunction.
We cannot be held responsible for compromised photos due to venue restrictions (limited access, poor lighting, obstructed views), officiant or venue rules that limit photographer positioning, or guests with cameras/phones blocking our shots. We’ll always do our best to work within any constraints, but some situations are beyond our control.
In any circumstance, our total liability shall not exceed the total amount you paid for our services. We are not liable for any indirect, incidental, or consequential damages.
New Jersey weather can be unpredictable — we get it! Rain, snow, or extreme weather doesn’t stop us. We’ll work with you and your venue to find covered or indoor alternatives, and honestly, some of the most stunning photos happen in the rain.
In cases of force majeure — events like natural disasters, pandemics, government restrictions, or other circumstances truly beyond anyone’s control — we’ll work with you to reschedule at no additional charge. If rescheduling isn’t possible, we’ll issue a full refund of all payments made.
We back up your images on multiple drives and cloud storage during the editing process. After your gallery has been delivered, we keep a backup of your final edited images for up to 12 months. After that period, we may delete the files to free up storage. We’d recommend downloading your full gallery as soon as it’s delivered.
Travel within 30 miles of Sparta, NJ is included. For weddings beyond that radius, a travel fee may apply and will be discussed at the time of booking. For destination weddings, travel, lodging, and meal costs are the responsibility of the client and will be outlined in your custom quote.
Your personal information is handled in accordance with our Privacy Policy. We respect your privacy and will never sell or share your information with unrelated third parties.
These terms are governed by the laws of the State of New Jersey. Any disputes arising from these terms or our services will be resolved in the courts of Sussex County, New Jersey.
We may update these terms from time to time. Changes will not apply retroactively to existing contracts. Your signed contract with us always takes precedence over these general terms.
